Please read these Terms & Conditions carefully before using our website or purchasing any products or services from Rock House Firearms, LLC ("Rock House Firearms," "we," "us," or "our"). By accessing our website at rockhousefirearms.com or placing an order you agree to be bound by these terms. If you do not agree to these terms do not use our website. AGE REQUIREMENT You must be at least 18 years of age to use this website or purchase any products or services from Rock House Firearms. By accessing this website you confirm that you are at least 18 years of age. Federal law establishes the following minimum age requirements for firearm purchases: - You must be at least 18 years of age to purchase rifles, shotguns, and long guns- You must be at least 21 years of age to purchase handguns and handgun ammunition Rock House Firearms will verify your age and identity at the time of any firearm transfer. If you do not meet the minimum age requirement for the specific firearm you have purchased your transfer will not be completed and the terms outlined in our Refund & Returns Policy will apply. --- 2. ELIGIBILITY TO PURCHASE FIREARMS Federal law prohibits certain persons from purchasing, possessing, or receiving firearms. By placing an order for a firearm through Rock House Firearms you represent and warrant that you are not prohibited from purchasing or possessing firearms under federal, state, or local law, including but not limited to the following: You are NOT eligible to purchase a firearm if you: - Have been convicted of a felony or any crime punishable by imprisonment for more than one year- Are a fugitive from justice- Are an unlawful user of or addicted to any controlled substance- Have been adjudicated as a mental defective or have been committed to a mental institution- Are an illegal alien or non-immigrant visa holder (with limited exceptions)- Have been discharged from the Armed Forces under dishonorable conditions- Have renounced your United States citizenship- Are subject to a qualifying restraining or protective order- Have been convicted of a misdemeanor crime of domestic violence- Are under indictment for a felony By completing a purchase you certify that you are legally eligible to purchase and possess firearms. Providing false information on ATF Form 4473 is a federal felony punishable by up to 10 years in prison and fines up to $250,000. Rock House Firearms is not liable for any consequences arising from false statements made by a purchaser. --- 3. FFL TRANSFER REQUIREMENT All firearm purchases — whether made online or in-store — are subject to federal firearms transfer laws. By purchasing a firearm through Rock House Firearms you acknowledge and agree to the following: - All firearm transfers require completion of ATF Form 4473- All firearm transfers require a NICS background check conducted through the FBI- Rock House Firearms cannot release a firearm until the background check is approved- If your background check is delayed, Rock House Firearms will hold your firearm until the delay is resolved or the transfer is denied- Rock House Firearms is not responsible for the outcome of any background check and cannot appeal a background check result on your behalf- Failed background checks result in forfeiture of the firearm with no refund as outlined in our Refund & Returns Policy --- 4. STATE AND LOCAL LAW COMPLIANCE Firearm laws vary by state and locality. It is your sole responsibility to know and comply with all applicable federal, state, and local laws regarding the purchase, possession, transfer, and use of firearms and ammunition in your jurisdiction. Rock House Firearms operates under Texas law and complies with all applicable federal firearms regulations. Rock House Firearms is not responsible for any purchase made in violation of the laws of your state or locality. If you are unsure whether a particular firearm or accessory is legal in your jurisdiction consult with a qualified attorney before placing your order. --- 5. NFA ITEMS — SILENCERS & SUPPRESSORS Rock House Firearms holds an active Special Occupational Tax (SOT) designation under the National Firearms Act (27 CFR 479.36), authorizing us to transfer NFA regulated items including silencers and suppressors. Purchases of NFA items are subject to additional federal requirements including: - Completion of ATF Form 4 or Form 5 as applicable- Payment of the $200 NFA tax stamp (per item)- ATF approval which may take several months- Compliance with all state and local NFA regulations NFA item purchases are final once the transfer process has been initiated. No refunds will be issued on NFA items once ATF paperwork has been submitted. --- 6. ONLINE PURCHASES & ORDER TERMS By placing an order on our website you agree to the following: - All prices are in US dollars and are subject to change without notice- Rock House Firearms reserves the right to cancel any order at any time for any reason including but not limited to product unavailability, pricing errors, or suspected fraud- In the event an order is cancelled you will be notified and a full refund will be issued- Firearm orders require in-person pickup at our Lufkin, TX location — firearms cannot be shipped directly to customers- Non-firearm items (accessories, parts, ammunition) may be shipped to your address subject to applicable shipping restrictions- Ammunition shipping is subject to carrier restrictions and hazmat regulations --- 7. GUNSMITHING SERVICES Rock House Firearms offers in-house gunsmithing services including Cerakote finishing, laser engraving, stippling, and hydrodip. By requesting and agreeing to gunsmithing services you agree to the following terms: A. WORK ORDER AGREEMENT All gunsmithing services require a signed work order detailing the scope of work to be performed. By signing the work order you acknowledge and approve the scope, nature, and expected outcome of the work. Rock House Firearms will perform the agreed upon work as described in the signed work order. B. NO REFUND ONCE WORK IS COMPLETED PER WORK ORDER Once Rock House Firearms has completed gunsmithing work in accordance with the agreed upon and signed work order no refund will be issued. It is the customer's responsibility to review and understand the work order before signing. C. REFUND IF WORK IS NOT COMPLETED PER WORK ORDER If Rock House Firearms fails to complete gunsmithing work in accordance with the agreed upon signed work order a refund will be issued. The refund amount will be determined based on the nature and extent of the deviation from the work order up to the full amount paid for the service. D. CUSTOMER SUPPLIED FIREARMS Rock House Firearms is not responsible for pre-existing damage, defects, or issues with firearms brought in for gunsmithing services. We will inspect each firearm upon drop-off and note any pre-existing conditions. Customers are encouraged to review and confirm the condition of their firearm at the time of drop-off. E. TURNAROUND TIMES Turnaround time estimates provided at the time of the work order are estimates only and are not guaranteed. Rock House Firearms will make every effort to complete work within the estimated timeframe. Delays beyond our control will be communicated to the customer promptly. --- 8. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law Rock House Firearms shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services including but not limited to: - Personal injury or property damage resulting from the use or misuse of any firearm purchased through Rock House Firearms- Any unauthorized access to or use of our servers or any personal information stored therein- Any interruption or cessation of transmission to or from our website- Any errors or omissions in any content on our website Our total liability to you for any claim arising from or related to these terms or your use of our website shall not exceed the amount you paid to Rock House Firearms for the specific product or service giving rise to the claim. --- 9. SAFE & RESPONSIBLE USE Rock House Firearms encourages all customers to practice safe and responsible firearm ownership. Always: - Store firearms safely and securely away from children and unauthorized persons- Follow all applicable laws regarding firearm storage, transportation, and use- Treat every firearm as if it is loaded- Never point a firearm at anything you are not willing to destroy- Keep your finger off the trigger until you are ready to shoot- Know your target and what is beyond it Rock House Firearms is not liable for any injury, death, or property damage resulting from the unsafe or unlawful use of any firearm purchased through our store. --- 10. INTELLECTUAL PROPERTY All content on this website including text, images, graphics, logos, and the Rock House Firearms name and logo are the property of Rock House Firearms, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without our express written permission. --- 11. PRIVACY Your use of our website is also governed by our Privacy Policy which is incorporated into these Terms & Conditions by reference. GOVERNING LAW These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved in the courts of Angelina County, Texas. --- 13.
