Rock House Firearms, LLC (“Rock House Firearms,” “we,” “us,” or “our”) respects your privacy. This policy explains what information we collect, how we use it, who we share it with, and what choices you have. It applies to rockhousefirearms.com and to our store at 3233 FM 2108, Lufkin, TX 75901.

IMPORTANT NOTICE REGARDING ATF COMPLIANCE

Rock House Firearms is a type 7 Federal Firearms Licensee (FFL #5-75-005-07-8F-42432) and a type 2 Special Occupational Taxpayer (SOT) holder. Federal law requires us to collect and retain certain information in connection with firearm transfers, including your name, address, date of birth, place of birth, physical description, and government-issued identification.

This information is retained as required by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and cannot be deleted at your request. It may be inspected by the ATF as permitted by law. These records are a legal obligation and are handled separately from the general website privacy practices described below.


 

1. AGE RESTRICTION

This website is intended for adults. You must be at least 18 years of age to use this site or purchase from us, and our site displays an age confirmation before you browse. We do not knowingly collect personal information from anyone under 18. See Section 12.

2. INFORMATION WE COLLECT

Information you give us directly:

  • Name, email address, phone number, and billing and shipping addresses when you create an account or place an order.
  • Account login credentials (passwords are stored in hashed form; we cannot read them).
  • Payment information, which is entered on a secure payment form and processed by our payment processor — we do not store full card numbers on our servers.
  • The federally licensed dealer (FFL) you select to receive a firearm transfer.
  • Government-issued identification and background-check information required by federal law for firearm transfers (ATF Form 1, 4, 5, or 4473).
  • Gunsmithing work orders, including the make, model, and serial number of firearms you bring to us for service.  All firearms that receive gunsmithing work must be logged in our records according to ATF guidelines which includes certain personal information about you.
  • Messages, quote requests, and inquiries you send us through our forms, email, or phone.
  • Your preferences if you subscribe to our email list.

Information collected automatically when you visit:

  • IP address, device type, browser type, and operating system.
  • Pages visited, products viewed and searched, and time spent on the site.
  • Referring website or search terms that brought you here.
  • Cookie and similar tracking data (see Section 7).

A note on sensitive information. Government identification, date of birth, and background-check data are collected only where federal firearms law requires it, are used only for that purpose and for our own recordkeeping obligations, and are never sold, rented, or used for marketing.

3. HOW WE USE YOUR INFORMATION

  • Process, fulfill, ship, and transfer your orders.
  • Create and maintain your customer account (an account is required to place an order; we do not offer guest checkout).
  • Communicate with you about orders, transfers, backorders, and service requests.
  • Comply with federal firearms law and ATF recordkeeping requirements.
  • Verify eligibility and apply the jurisdictional restrictions that govern what we can lawfully ship to your address.
  • Respond to your questions, quote requests, and service inquiries.
  • Send order confirmations, shipping notices, and customer service messages.
  • Send marketing email only if you have opted in, which you may stop at any time.
  • Detect and prevent fraud, abuse, and unauthorized access, and maintain the security of our site.
  • Improve our website, product catalog, and customer experience.
  • Maintain business records and meet tax, accounting, and legal obligations.

We do not sell your personal information. We do not share your personal information with third parties for their own advertising or marketing purposes, and we do not engage in “targeted advertising” or “profiling” as those terms are defined by state privacy laws.

4. ATF & LEGAL COMPLIANCE

As a federally licensed firearms dealer, we are required by law to:

  • Verify the identity of every firearm purchaser and transfer recipient.
  • Complete ATF Form 4473 for every firearm transfer we conduct.
  • Submit NICS background checks through the FBI unless an exemption applies.
  • Maintain an Acquisition & Disposition record of every firearm we receive and transfer.
  • Retain transfer records for the period required by federal law.

This information is collected and retained as a legal obligation. It cannot be deleted at customer request and may be inspected by the ATF as permitted by law. By purchasing a firearm or initiating a transfer through Rock House Firearms, you acknowledge and consent to this legally required collection and retention.

5. PAYMENT PROCESSING

Payment transactions on our website are processed by our third-party payment processor, Fortis Payment Systems. Your card data is transmitted directly to the processor over an encrypted connection and is handled in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). We do not store full credit or debit card numbers. We retain only the information needed to identify a transaction, such as the last four digits, card brand, authorization result, and billing address.

Please review your payment processor’s own privacy policy for details on how it handles payment data.

6. HOW WE SHARE INFORMATION

We do not sell, trade, or rent your personal information. We share it only in these limited circumstances:

  • Receiving FFL dealers. When you buy a firearm for transfer, we share the information necessary to complete that shipment and transfer — typically your name and contact information — with the licensed dealer you selected. Once the firearm reaches that dealer, the dealer conducts the ATF Form 4473 and background check under its own license, and the dealer’s handling of your information is governed by that dealer’s own privacy practices.
  • Distributors and fulfillment partners. Many items ship directly from our distributors. We provide them the shipping information needed to fulfill your order.
  • Shipping carriers, to deliver your order and, where required, to obtain adult signature at delivery.
  • Service providers who help us operate the business — website hosting, order and inventory management, compliance software, email delivery, analytics, and payment processing — who are permitted to use your information only to provide those services.
  • The ATF and law enforcement, as required by federal firearms law, or in response to a valid subpoena, court order, or other lawful process.
  • To protect rights and safety — where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Rock House Firearms, our customers, or the public, or to investigate suspected fraud, straw purchasing, or unlawful activity.
  • Business transfer — in connection with a sale, merger, or reorganization of our business, in which case your information remains subject to this policy.

7. COOKIES & TRACKING

Our website uses cookies — small text files stored on your device — and similar technologies to:

  • Keep items in your shopping cart and maintain your session through checkout.
  • Remember your login status and preferences.
  • Remember your age confirmation and consent choices.
  • Secure the site and prevent fraud.
  • Understand how visitors find and use our site (analytics).

We use WooCommerce, which sets cookies that are strictly necessary for cart and checkout functionality; caching and performance tools that set technical cookies; a consent management tool that lets you accept or decline non-essential cookies and change that choice later; and standard analytics tools to measure site traffic and usage patterns.

You can decline non-essential cookies through our consent banner and can block or delete cookies in your browser settings. Disabling cookies may break site functionality, including the cart and checkout. Our site honors browser-based opt-out signals, including Global Privacy Control (GPC), where required by law.

8. EMAIL & MARKETING COMMUNICATIONS

Transactional messages — order confirmations, shipping notices, transfer status, and service updates — are part of fulfilling your order and are sent to all customers.

Marketing email is sent only to customers who have opted in. Every marketing message includes an unsubscribe link, and you may also opt out at any time by emailing support@rockhousefirearms.com. Opting out of marketing does not stop transactional messages about orders you have placed.

9. DATA SECURITY

We take reasonable administrative, technical, and physical measures to protect your personal information from unauthorized access, disclosure, alteration, or misuse. Our website uses SSL/TLS encryption (HTTPS) for all data transmission. Access to customer data and ATF records is limited to authorized personnel, and physical records are stored securely at our licensed premises.

No method of transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and applicable authorities as required by law.

10. DATA RETENTION

We keep personal information only as long as necessary for the purposes described in this policy:

  • ATF firearm transfer records: as required by federal law (Form 4473 records and Acquisition & Disposition records are retained for the full period the ATF requires, currently no less than 20 years, and are surrendered to the ATF if we cease operations).
  • Order, transaction, and tax records: a minimum of 7 years.
  • Customer account information: until you ask us to delete it, subject to legal retention requirements.
  • Gunsmithing work orders: a minimum of 2 years.
  • Contact and inquiry records: up to 3 years.
  • Website analytics data: typically up to 26 months.

11. YOUR PRIVACY RIGHTS

Subject to applicable law and our legal obligations, you may:

  • Access the personal information we hold about you.
  • Correct inaccurate information.
  • Delete your information — except records we are required to retain, including ATF transfer records and tax and accounting records.
  • Obtain a copy of information you provided to us, in a portable format.
  • Opt out of marketing communications at any time.
  • Opt out of the sale or sharing of personal information for targeted advertising — we do not engage in these practices, so there is nothing to opt out of.
  • Be free from discrimination for exercising any of these rights.

Residents of states with comprehensive privacy laws — including Texas, California, Virginia, Colorado, Connecticut, Utah, and others as those laws take effect — have these rights under their state statutes. California residents may also request the categories of personal information collected, the purposes for collection, and the categories of third parties with whom it was shared; California’s “Shine the Light” law does not apply to us because we do not share personal information for third-party direct marketing.

To exercise any right, email support@rockhousefirearms.com with your request and enough information for us to verify your identity and locate your records. We will respond within the timeframe required by applicable law, generally 45 days. If we cannot honor a request because federal firearms recordkeeping law requires us to keep the record, we will tell you so and explain why. You may designate an authorized agent to make a request on your behalf; we will require proof of that authorization.

If we deny your request, you may appeal by replying to our response with the word “Appeal” and your reasons. We will respond to an appeal within 60 days.

12. CHILDREN’S PRIVACY

Our website is not directed at children, and you must be 18 or older to use it. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a minor, contact us at support@rockhousefirearms.com and we will delete it promptly.

13. UNITED STATES ONLY

Rock House Firearms sells and ships within the United States only, and our website and services are directed to U.S. residents. Information we collect is stored and processed in the United States. We do not knowingly offer goods or services to, or monitor the behavior of, individuals in the European Economic Area or the United Kingdom.

14. THIRD-PARTY LINKS

Our website may link to third-party websites, including manufacturer sites, dealer locators, and payment pages. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policy of any third-party site you visit.

15. CHANGES TO THIS POLICY

We may update this privacy policy from time to time. When we make changes we will revise the “Last updated” date at the top of this page, and we will provide more prominent notice for material changes. Your continued use of our website after changes are posted constitutes acceptance of the updated policy.
